Clarification on Trash Violations, Temporary Suspension & ACC reminder

We want to address recent concerns regarding trash violations issued by the HOA. To clarify, the HOA has been enforcing these violations based on a 2017 Community-Wide Standard adopted by the Declarant Board.
To ensure all homeowners have an opportunity to review these standards, we will be temporarily suspending enforcement of trash receptacle placement violations, effective immediately, until April 1, 2025. Enforcement will resume on that date in accordance with the established standard.
Additionally, according to the Texas Property Code § 209.006, the HOA is required to send all violation notices via united states postal service USPS and certified mail to the homeowners last known mailing address as recorded in HOA records. When enforcement resumes, the HOA will continue to follow this requirement to ensure compliance with state law. The key points of this statute include:
1. Written Notice Requirement – Before enforcing a violation, the HOA must send a written notice to the homeowner.
2. Mailing Address – The notice must be sent to the owner’s last known address as recorded in the HOA’s records.
3. Certified Mail – The notice must be sent via certified mail to ensure proper delivery and documentation.
This law ensures that homeowners receive formal, documented notice before any enforcement actions, such as fines or legal proceedings, take place.

Acceptable Trash Screening Modifications
For homeowners who prefer to keep their trash receptacles on the side of their homes, approved screening solutions may be used to maintain community aesthetics. These may include:
Fencing extensions or enclosures that match the home’s exterior & existing fence.
Decorative lattice or slatted panelsShrubbery or landscaping screens (must be well-maintained)
Lastly, we wanted to send a reminder that all exterior modifications and improvements require an ACC application AND approval prior to work commencing.
